1. Who the right of withdrawal applies to
The rules below apply to individuals buying outside their professional activity, where the contract falls under Government Emergency Ordinance 34/2014. For construction, installation or mixed service contracts, this is checked separately. Businesses do not automatically have the statutory 14-day right of withdrawal.
2. Standard goods bought at a distance
A consumer may withdraw from the contract, without giving a reason, within 14 days of receiving the goods. The statement can be sent by email to office@modulixindustrial.ro or by post to 112 Șoseaua Alba Iulia, Sibiu, Romania, without prior approval. The template below is optional; any unequivocal statement is enough.
3. Custom-made goods
The right of withdrawal does not apply to goods made to the consumer's specifications or clearly personalised, such as products made to individual dimensions. The mere fact that goods are imported, ordered in or not in stock does not justify the exception. This is stated in the quote, before the contract. Rights regarding non-conformity still apply.
4. Return and refund
Goods must be returned within 14 days of notifying withdrawal. The direct cost of return is borne by the consumer only if they were informed beforehand; for goods that cannot be returned by post, the cost or an estimate is given before the contract. Return address: 112 Șoseaua Alba Iulia, Sibiu, Romania. We do not charge a fixed restocking fee.
The refund, including the initial standard delivery, is made within 14 days of being informed of the withdrawal and may be withheld until the goods or proof of dispatch are received. Any reduction in value can only be justified by handling beyond what is needed to inspect the goods.
5. Conformity of goods (legal guarantee)
For consumer sales falling under Government Emergency Ordinance 140/2021, the seller is liable for any lack of conformity existing at delivery and found within the two-year legal period. The customer may obtain repair or replacement and, where the legal conditions are met, a price reduction or termination of the contract.
Repair or replacement is free of charge and without significant inconvenience, within at most 15 calendar days of informing the seller, a period agreed in writing taking into account the nature of the goods. An additional commercial guarantee is given only where provided for the product and does not replace the legal guarantee. For business customers, the guarantees agreed by contract apply.
6. How to make a complaint
Write to office@modulixindustrial.ro, call +40 755 823 225 or send post to 112 Șoseaua Alba Iulia, Sibiu, Romania. Give your name, contact details, order number, the product and the problem you noticed. Photos help, but not having them does not cancel the request or your legal rights. We log the request and tell you how it will be resolved. If the problem may affect safety, stop using the product, where safe to do so, and contact us.
7. Alternative dispute resolution
Consumers can use ANPC's alternative dispute resolution (SAL) system: reclamatiisal.anpc.ro. Information about the authority: anpc.ro. These options do not remove access to the competent courts.
